Terms of Service

1. Acceptance of terms

By accessing or using TBrain Management Hub ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Eligibility and accounts

The Service is provided to TBrain employees, contractors, and invited partners or clients. Access is granted by invitation only.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You must provide accurate information and promptly update it if it changes. You must not impersonate another person or entity.
You must notify us immediately of any unauthorized use of your account by emailing admin@tbrain.ai.

3. Acceptable use

You agree NOT to:

Use the Service for any illegal or unauthorized purpose.
Attempt to gain access to projects, data, or features you have not been granted permission to view.
Upload malicious code, viruses, or content intended to disrupt or damage the Service.
Scrape, data-mine, or extract data from the Service by automated means without our prior written consent.
Reverse-engineer, decompile, or attempt to derive source code from the Service.
Share confidential project data with parties outside the authorized project membership.

4. Content and ownership

Your content: You retain ownership of submissions, comments, and other content you upload. By uploading, you grant TBrain a non-exclusive license to host, process, and display that content solely for operating the Service and fulfilling project obligations.
Our content: The Service, including software, designs, logos, and documentation, is the property of TBrain and protected by intellectual-property laws. You may not copy, modify, or redistribute it without permission.

5. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect and use your data.

6. Service availability

We strive for high availability but do not guarantee the Service will be uninterrupted or error-free. We may suspend or modify the Service for maintenance, security, or operational reasons. We will provide reasonable notice of significant changes where feasible.

7. Termination

We may suspend or terminate your access to the Service at any time, without notice, for conduct that violates these Terms, harms other users, or exposes TBrain to legal liability. You may terminate your account at any time by contacting us.

8. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the maximum extent permitted by law, TBrain shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. Our total liability in any matter shall not exceed the amount you paid (if any) for the Service in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless TBrain, its officers, employees, and agents from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Service.

11. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated via email or an in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to its conflict-of-law provisions. Any disputes shall be resolved in the competent courts of Ho Chi Minh City.
